
For the purpose of these terms and conditions, Party Hire Essentials, Doncaster Photo Booths, and South Yorkshire Photo Booths are the same business entity and shall be referred to as PHE. Any reference to “the Client” refers to the person or persons who have sought to employ the services of PHE and proceed to place further orders.
- APPLICABLE LAW
a) The laws of England and Wales shall govern this agreement. These terms and conditions shall not be varied except by agreement in writing.
b) In the event of any conflict between these terms and conditions and those issued or submitted by the Client, these Terms and Conditions shall prevail unless otherwise agreed in writing.
- BOOKING FEE & PAYMENTS
a) By making a booking with PHE, the Client enters into a contract and agrees to abide by the terms and conditions outlined in this document.
b) Booking fees for any service with PHE are non-refundable, except in the event PHE cancels the booking.
c) A non-refundable deposit/booking fee (typically £50) is required for all services at the time of booking. The remaining balance must be paid no later than four weeks before the event. Failure to pay the outstanding balance may result in cancellation, and the booking fee will be retained.
d) Payment plans for larger orders may be arranged at PHE’s discretion.
e) If the event is less than four weeks away at the time of booking, the full balance is required.
- FULFILMENT OF OBLIGATIONS
a) PHE shall not be liable for any failure, in whole or in part, to fulfil its obligations due to events beyond its control, including but not limited to equipment failure, power outages, inclement weather, illness, injury, or transportation issues.
b) The Client acknowledges that the photographic/videographic coverage will be determined by PHE’s professional expertise. Special requests will be considered but are not guaranteed.
c) In the event of total equipment failure, PHE will endeavour to provide an alternative solution or a refund of any applicable fees. Neither party shall be liable for indirect or consequential losses.
d) A welcome pack and/or preparation brochure will be provided before the event. The Client is responsible for ensuring they meet the requirements outlined in this documentation. Failure to do so may result in an inability to provide full services, for which PHE is not liable.
- COPYRIGHT & IMAGE USE
a) Copyright for all images and videos remains with PHE.
b) A disclaimer will be provided to each participant using the photobooth services, allowing PHE to use images for promotional purposes. Users must agree to these terms to receive copies of their images/footage.
c) Clients retain the right to use images for personal, non-commercial purposes.
- COOLING-OFF PERIOD & CANCELLATIONS
a) The Client has a 14-day cooling-off period from the date PHE acknowledges receipt of the booking fee.
b) Cancellations outside the cooling-off period will result in the loss of the booking fee. Rescheduling may be possible at PHE’s discretion but is not guaranteed.
- PRIVACY POLICY
a) PHE does not share or distribute any personal or contact information obtained from clients. All information is confidential and protected under GDPR.
b) Clients may request the removal of their data by written request via email or letter. Otherwise, PHE retains customer data for up to three years post-event, after which it is securely deleted.
c) PHE’s full Privacy Policy can be viewed at www.partyhireessentials.com.
- PHOTO & VIDEO RETENTION POLICY
a) All images and videos are retained for 12 months after the date of hire unless otherwise agreed.
- DAMAGE TO EQUIPMENT & SAFETY
a) The Client agrees to take full responsibility for any damage sustained to hired equipment caused by misuse by themselves or their guests. The Client agrees to cover the costs of repair or replacement.
b) Examples of misuse include but are not limited to spilling liquids, tampering with wiring, excessive force, or improper use.
c) PHE reserves the right to terminate the booking at any point during an event if safety concerns arise or if equipment misuse is detected. This decision is at the discretion of PHE staff.
N.B. IF ANY PROVISION OF THIS AGREEMENT IS HELD TO BE INVALID OR UNENFORCEABLE UNDER THE LAW, THE VALIDITY OF THIS AGREEMENT AS A WHOLE SHALL NOT BE AFFECTED, AND THE OTHER PROVISIONS SHALL REMAIN IN FULL FORCE AND EFFECT.
By using PHE’s services, the Client acknowledges they have read, understood, and agreed to these terms and conditions in full.
